The agreement between your organization and TrustXP.

These Terms of Service ("Terms") govern your organization's use of the TrustXP platform and related services ("Service") provided by TrustXP ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms on behalf of your organization ("Customer", "you").
TrustXP is an employee trust measurement platform. The Service allows organizations to run anonymous pulse surveys measuring trust across five dimensions (competence, fairness, reciprocity, identity, and transparency), view aggregated results on a dashboard, and act on trust insights over time.
The Service is provided as a hosted application. We do not install software in your environment.
To use TrustXP, an authorized representative of your organization must create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You agree to provide accurate and current information when creating an account and to update it as needed. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
You agree to use the Service only for its intended purpose: measuring and improving trust within your organization. You may not:
You retain all rights to the data you provide to TrustXP ("Customer Data"). We do not claim ownership of Customer Data. We process it solely to provide the Service, as described in our Privacy Policy and Data Processing Addendum.
You are responsible for ensuring that you have the necessary rights and consents to provide personal data to TrustXP, including the data of the people enrolled in your pulses.
Upon termination of your account, you may request export or deletion of your Customer Data. We will fulfill such requests within 30 days, subject to any legal retention obligations.
Pulse responses are stored without any link to the individual who submitted them. We will not provide Customer with any means to identify individual respondents. The minimum-response threshold prevents display of results for groups too small to protect anonymity. This commitment is structural and not subject to override by Customer request.
The Service is offered in tiers based on the number of people in your organization. Current pricing is published on our pricing page. All plans include the full feature set; pricing scales by company size only.
Teams of 10 or fewer may use the Service at no charge. Paid plans are billed monthly or annually. Annual billing includes two months free.
Payments are processed by Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on file at the applicable billing interval. All fees are quoted in euros and are exclusive of applicable taxes unless stated otherwise.
If payment fails, we will attempt to notify you and provide a reasonable grace period before suspending access to the Service.
You may cancel your subscription at any time through the platform or by contacting us at info@trustxp.com. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods.
After cancellation, your account and data will remain accessible in a read-only state for 30 days, after which we will delete your data unless you request otherwise.
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by circumstances beyond our reasonable control, including internet outages, third-party service failures, or force majeure events.
TrustXP and its associated trademarks, content, and technology are the intellectual property of TrustXP. These Terms do not grant you any rights to our intellectual property beyond what is necessary to use the Service.
The Compounding Trust Model, which underpins TrustXP's measurement methodology, is based on the work of Timen Baart. The model's conceptual framework is described at compoundingtrust.com.
To the maximum extent permitted by law, TrustXP's total liability under these Terms is limited to the fees paid by Customer in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for fraud or gross negligence.
You agree to indemnify TrustXP against claims arising from your use of the Service in violation of these Terms, your provision of data without necessary rights or consents, or your violation of applicable law.
We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect, by email or through the platform. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or the Service will be submitted to the competent courts in the Netherlands.
